Do you deliver every image you shoot? 

No, I do not. I eliminate images that appear as duplicates, missed focused shots, test shots, and shots with bad facial expressions. Sometimes photos are captured with a lower aperture (better for low-light scenarios), so extra photos have to be taken. I don’t expect clients to have the time or expertise to zoom in on each image to see which is the sharpest and best, so I spend hours doing that on my end. One other example would be when dealing with candid laughs or emotional tears. Sometimes those photos produce some unflattering facial expressions so I take extra photos to ensure there are a few flattering ones to choose from. 


Do you edit all of the images in our image gallery?

Yes I do. Every image I deliver is curated and post produced with my unique signature style. This process involves color correction, clarity adjustment, exposure adjustment, tone mapping, as well as other corrections that each individual image may need to best pop for the viewer. Some photographers will not post produce all of the images meaning you may have some photos that aren’t cohesive with the gallery, are too dark, the skin tones are off, no composition cropping and other photography flaws. 

 

What do you mean by professionally retouched photos?

Retouched photos include touch ups, removal of blemishes, bags under the eyes, decreasing the appearance of wrinkles, removal of fly-away hairs, etc. There is also a more custom based post production process which is more catered toward the specificity of the clients’ needs. It requires more extensive work in Photoshop such as removing entire objects from the photos, changing the size and shape of body parts or other objects in the photos, and adding objects to photos. This would be an additional charge. Please contact Ana Ciubara for a quote for the custom post production. 

 

When can we expect to see our photos?

The initial gallery for viewing will be ready within 10-14 days.

Post-production for solo shoots are completed within 10-15 days of the shoot. 

Post-production for couples/family shoots are completed within 15-20 days of the shoot.

If you require the images to be completed prior to the given time frame, a rush process fee of $150 will be charged.


What rights do I have to digital prints?

You have the right to reprint images whenever you want. However you may not sell your images for profit or publish your images without written consent from Ana Ciubara. 


Are there travel fees associated with photoshoots?

If the shoot is in Los Angeles, there won’t be a travel fee. If the shoot is outside of LA, a travel fee will be charged. Rates will depend on the mileage and time on the road. Please contact Ana Ciubara to get an estimate for the destination of the shoot.

 

 

Booking Terms—

Deposit: Ana Ciubara Photography (ACP) requires a $150 deposit to reserve your date and time. The deposit will go toward the package chosen. The remainder of the balance will be paid before the shoot. 

Late to shoot: There is a grace period of 15 minutes when the client is late. The shoot will still end at the initial agreed upon time. If extra time is needed to photograph, it will be an additional $150 per hour. 

Cancellation or rescheduling: Any booking deposit fee paid to the Photographer will not be refunded but can be used as the deposit on the rescheduled date.

Photographic Materials and Copyright: All photographic materials, photos, shall be the exclusive property of the Photographer. The Photographer owns the copyright in all images created and may use the work for samples, contests, exhibition, advertising and self-promotion. 

Client’s Usage: The Client is obtaining prints for personal use only. The Client shall not sell prints or authorize any reproductions by parties other than the Photographer. If the client is obtaining a print intended for reproduction. Client shall request that a copyright and credit notice for the Photographer be placed adjacent to the photograph.

Social Media: This applies to all social media, including Instagram, Facebook and blogs. When published online, it is required that citation of the photographer be made. The client agrees that they will not alter any photographs that are placed in public on the internet. The client agrees to be responsible for any family member or friend who posts our photographs online and agrees that they cannot be cropped (with the exception of the forced cropping for Instagram and Facebook’s Timeline), altered in color, or edited in any way as it is not a representation of Photographer’s work.

Failure to Perform: If the Photographer cannot perform this Agreement due to a fire or other casualty, strike, or other cause beyond the control of the parties, or due to the Photographer’s illness, then the Photographer shall return any funds previously paid to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

High-Resolution: Images will be deliverable in High-Resolution. 

Backed Up Files: Ana Ciubara Photography keeps client files for up to 1 year after the photography session. ACP is not liable for any claims after this period. All client files will be deleted and backups will also be deleted after this period.

Liability: It is the client’s responsibility to take care of children at the shoot location of choice; ACP will not accept any responsibility due to any accident to children or damage to public or private properties during the photo shooting or consultation session.

It is understood that no other photographer, amateur or professional, shall be allowed to photograph at the venue (wedding, portrait, family photography , etc.) while Ana Ciubara is working, and that any breach of this agreement will constitute a reason for non-completion of the job with no liability to the Photographer and loss of initial deposit by the client. 

Editing: Client accepts that all photographs will be taken and edited at the photographer’s discretion based on the photographer’s experience and artistic view. If the client has special requests shall create a “shot list” of all shots that they require.

Deliverable Images: All deliverable images as per contract will have standard image editing (including: light skin retouch, light and color adjustments). Any extra edits requested by the client will cost the client $35 per image if accepted by the Photographer. extra image adjustments include (change the size of the body or parts of the body, replace parts of the body from another image, change the color of parts of the body, extra skin retouch, replace or swap background). It is also understood that unless hair and makeup is included in the contract, Photographer is not responsible to fix hair or skin, or makeup problems.

It is also understood that Photographer is not responsible to fix photos to cover parts of your body that you do not wish to be seen in the photo, unless it was confirmed with the photographer in writing and an additional fee is paid.

Breaks: The photographer(s) will be allowed one 20 minutes break and bathroom breaks when necessary. Each photographer will be provided a full guest meal for any photography session lasting longer than 5 hours. If no meal is provided, the photographer reserves the right to go off-site for a meal for 45 minutes.

Changes to the shoot day details: It is understood that it is the client’s responsibility to inform the Photographer by email for any date or location changes (including but not limited to wedding dates, baby delivery for birth or hospital photography). ACP is not liable for any claims for messages sent by mobile text messages or social network websites.

Photo Cooperation: In the event that the family/guests are taking photos, ACP is not responsible for obstructed photos or photos ruined due to other flashes going off or any other behavior from guests. ACP is not responsible for obstructed or ruined photos due to activities by other vendors and venue staff.
